No. 3197 Simeon Howe To George Young

This indenture made this seventeenth day of May in the year of our Lord one thousand eight hundred and fifty three between Simeon Howe formerly of the Parish of Saint George in the County of Charlotte and Province of New Brunswick merchant and Hannah his wife of the one part, and George Young of the Parish of Portland in the City and County of St. John merchant of the other part, Whereas the said Simeon Howe did by a certain deed poll or instrument in writing bearing date the sixth day of February one thousand eight hundred and forty one in consideration of the sum of six hundred and twenty five pounds to him paid by John Pollok then of the city of St. John aforesaid merchant but now deceased grant bargain sell and convey unto the said John Pollok his heirs and assigns forever certain lands tenements hereditaments and premises in the said indenture described as follows, All my right title and interest in and to a certain piece of land extending from highwater mark to the road as it at present runs leading from the red store to the Magaguadavic Portage and fronting the said road ten rods being the joint parts of two five rod lots numbers Three & Four agreeable to a plan drawn by James Wilson dated the second of November one thousand eight hundred and twenty seven of the Dominicus Milliken and Orange Seelye property (so called) together with all the buildings thereon and all the privileges and appurtenances to the same belonging being the same which is now occupied by me and held by virtue of a lease from Lachlan Cameron to William C. Pendleton dated the first day of May one thousand eight hundred and thirty two and deeded by the said William C. Pendleton by deed dated sixteenth November one thousand eight hundred and thirty six and registered with the Records of Charlotte County on the 462nd and 463rd page of Book lettered P. Also a certain other lot of land situate in the Parish of Saint George aforesaid together with the buildings thereon and all the privileges and appurtenances to the same belonging being the same which was deeded by Peter Clinch to James N. Hall by deed dated twenty fourth of November one thousand eight hundred and thirty one and registered with the records of said County of Charlotte on the 247th and 248th pages of Book lettered L and by the said James N. Hall to me by deed dated second of September one thousand eight hundred and thirty seven and registered with the records of said County of Charlotte on the 239th and 240th pages of Book lettered Q. Also a certain other lot of land situate in the Parish of Saint George aforesaid at the second falls together with all the buildings thereon and all the privileges and appurtenances to the same belonging meaning to convey the same and all that is conveyed to me by Colin Campbell Esquire late Sheriff of said County of Charlotte by deed dated February twentieth one thousand eight hundred and thirty nine and registered with the records of said County of Charlotte on the 573rd 574th & 575th pages of Book R. Also all my right title and interest in and to a certain Saw Mill & Lease of Land called the Red Rock Mill situate in the said Parish of Saint George with all the privileges and appurtenances to the same belonging my right to the same being by virtue of a Lease from Robert Stannus to Daniel Brockway and transferred by assignment by the said Daniel Brockway to William C. Pendleton and by the said William C. Pendleton to Amos Pendleton and by the said Amos Pendleton to me by assignment dated the nineteenth July one thousand eight hundred and thirty eight which is registered with the records of said County of Charlotte on the 32nd page of Book R. Also all my right title and interest in and to a certain other lot of land together with all the buildings thereon and all the privileges and appurtenances to the same belonging situate at the Second Falls in the said Parish of Saint George my right to the same being the assignment by S. L. Blake of a Bond given by Gordon Gildchrist of Saint Andrews to the said S. L Blake conditioned to deed him a certain lot of land therein described on the payment of certain notes therein described meaning to convey all the right I have by virtue of the said S. L. Blake's assignment of the said Bond. Also two undivided third parts of a certain lot of land situate in the Parish of Saint Patricks in the said County of Charlotte: Beginning at a popple tree marked and standing on the Eastern Shore of the Digdeguash Lake in the northwest angle of a Grant under the Great Seal of the said Province to one Alexander Mylne bearing date the second of May one thousand eight hundred and twenty five thence running south eighty nine degrees east eleven chains of four poles each and fifty links to a hemlock stake thence south one degree west eighteen chains to two spruce trees marked thence north eighty nine degrees west sixteen chains and fifty links to a popple tree standing on the Eastern shore of the Digdeguash Lake aforesaid and thence following the several courses of the said shore northerly to the place of beginning containing twenty acres more or less together with two undivided third parts of the mill privilege situate and being thereon and two undivided third parts of the saw mill thereon standing together with all and singular the rights members & appurtenances to the same belonging my rights to the same being by virtue of a deed from Colin Campbell Esquire aforesaid dated fourth June one thousand eight hundred and thirty nine and registered with the records of said County of Charlotte on the 533rd  534th and 535th pages of Book R. To have to and to hold the aforegranted premises to the said John Pollok his heirs and assigns forever, which said Deed Poll or Instrument in writing was subject to a Proviso therein contained for the redemption thereof upon the payment of the said sum of six hundred and twenty five pounds in the manner therein mentioned and was duly signed sealed and delivered by the said Simeon Howe and Hannah his wife and was by them duly acknowledged and was also duly recorded in the Office of the Register of Deeds in and for the said County of Charlotte in Book S pages 339 and 340 as by reference thereto will more fully appear. And whereas the said Simeon Howe is the only person entitled to redeem the said mortgaged premises and whereas he has sold his Equity of Redemption therein to the said George Young for the sum of thirty five pounds now this Indenture witnesseth that the said Simeon Howe and Hannah his wife for and in consideration of the sum of thirty five pounds lawful money of New Brunswick to them paid by the said George Young at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have and each of them hath granted bargained sold remised released and forever quit claimed unto the said George Young his heirs and assigns, all the right title interest estate dower right of dower property claim and demand both at Law and in Equity of them the said Simeon Howe and Hannah his wife in and to the said lands tenements hereditaments messuages and premises mentioned and described in the said hereinbefore recited deed Poll or Instrument in writing by way of mortgage. To have to hold all and singular the said hereby bargained sold and released premises unto and to the use of the said George Young his heirs and assigns forever. In witness whereof the said parties have hereto set their hands and seals the day and year first above written.

County of Charlotte Province of New Brunswick Be it remembered that on this seventeenth day of May in the year of our Lord one thousand eight hundred and fifty three before me Abraham J. Wetmore Esquire one of Her Majesty's Justices of the Peace in and for the County aforesaid came and appeared Simeon Howe one of the Grantors within named by Henry E. Seelye his attorney who acknowledged that he had as such Attorney signed sealed and delivered the within indenture as the act and deed of the said Simeon Howe to and for the uses and purposes therein mentioned and contained. And the said Hannah wife of the said Simeon Howe the other Grantor within named being by me at the same time examined separate and apart from her said husband did acknowledge and declare that she executed the said Indenture as her act and deed to and for the uses and purposes therein mentioned freely and voluntarily and without any fear threat or compulsion from him her said husband.
